FOREST LAKES SUBDIVISION

RESTRICTIONS, USES AND COVENANTS


THE STATE OF TEXAS

KNOW ALL MEN BY THESE PRESENTS

COUNTY OF BASTROP


THAT THE FOREST LAKES PROPERTY OWNERS ASSOCIATION, A TEXAS Corporation, the successor to WESTERN WOODS, INC., do hereby impose upon said property the following Restrictions, Uses and Covenants:

1. Said tract shall be used exclusively for residential purposes, and no part there-of shall be used for commercial purposes.

2. No improvements or dwelling place shall be erected, placed or permitted to remain on said tract nearer than 10 feet to any side line or the rear line, nor closer than 25 feet to the front line of said tract.

3. No residence building, out building or any structure shall be erected, assembled, moved or permitted to remain on said tract until the plans and specifications for the same have been approved by Forest Lakes Property Owners Association, or by its nominees; No such residential building shall be occupied and used until the exterior is completely finished according to such plans and specifications, and further provided that exterior walls, not of masonry, shall have at least two coats of paint, and any building or structure is to be completed within 270 days from time it is started.

4. All plumbing shall be connected to sanitary sewer, or septic tank, and shall comply with the minimum standards and requirements of the County of Bastrop and the State of Texas.

5. No mobile, modular, manufactured, re-manufactured, used or portable home will be placed on any parcel in the subdivision. Residential development is restricted to conventional site built homes only.

6. Barns and out buildings to be at least 100 feet back from street.

7. No fowls or animals, other than pets or school projects, to be allowed; and such are to be caged or fenced in and one large animal per lot.

8. There shall be no noxious, offensive, unlawful, or immoral use of said premises, nor shall any use of said tract be made which constitutes a nuisance to the neighborhood.

9. No inoperative motor vehicles, or bodies or chassis of motor vehicles without motors, shall be stored or permitted to remain on said tract.

10. Invalidation of any one or more of these covenants and restrictions by judgment of court having jurisdiction shall in no wise effect the validity of any other covenants and restrictions which shall remain in force and effect.

11. No motor boats or house boats on lakes.

12. The following is reserved as an easement for the use and enjoyment of all lot owners.

a.) The water surface plus 10 feet of land surface from the high water line around the lakes.

b.) The surface area of the four dams.

c.) The South 20' lot 105.

d.) The North 30' lot 116.

e.) The North 70' lot 120.

f.) The North 15' lot 127.

g.) The North 15' lot 128.

h.) The South 20' lot 137.

i.) The South 10' lot 146.

13. The lakes referred to in these restrictions are the 4 lakes on the back 1/2 of the subdivision.

14. Forest Lakes Property Owners Association, and assigns shall have the full right to prosecute any violation of these restrictions and covenants at law or at equity against Purchaser, their heirs, assigns and successors.

15. Each Property Owner in Forest Lakes Subdivision is hereby subject to an annual maintenance charge of Ten ($10.00) Dollars per year, payable annually on the first day of January each year, beginning January 1, 1999, and each succeding year thereafter until terminated as provided below, to the Forest Lakes Property Owners Association, its successors and assigns, for the purpose of creating a fund, known as the "Maintenance Fund." The Forest Lakes Property Owners Association may increase or reduce the maintenance charge from time to time by action applied uniformly to all Property Owner in the Subdivision. By acceptance of contract of sale, deed or other instrument of conveyance, each owner agrees and consents to the maintenance charge as provided herein. The act of the Forest Lakes Property Owners Association and expenditures of the Maintenance Fund shall be final as long as it acts in good faith.

16. Fishing restricted to pole fishing.

17. No water pumped from lakes.

18. Any re-subdivision of any lot or any multiunit dwelling on any lot must be approved by the developer or his designated architectural control committee.

19. The Term of Restrictions shall be for a period from the filing of this instrument for record in Bastrop County, Texas until the January 5, 2009 after which date such Restrictions shall be automatically extended for successive periods of ten (10) years each, unless and until, by instruments executed by the Forest Lakes Property Owners Association, and duly recorded in the Deed Records of Bastrop County, Texas, such restrictions are altered, rescinded, modified or changed, in whole or in part. The invalidity, violation, abandonment, waiver of failure to enforce any one or more of any part of the provisions of this document shall in no way affect or impair the remaining provisions or parts thereof, which shall remain in full force and effect.


The above Restrictions, Uses and Covenants shall be and are hereby imposed upon all of the certain 164.06 acres of land in Bastrop County, Texas more commonly known as Forest Lakes Subdivision, By the undersigned authority of the Forest Lakes Property Owners Association.

EXECUTED this 1st Day of January 1999 by the Directors of the Forest Lakes Property Owners Association.
